Privacy Policy

At Imaging Panda Inc. (“Imaging Panda”), protecting your private information is our priority. This Statement of Privacy applies to www.imagingpanda.com and Imaging Panda, Inc. and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Imaging Panda, Inc. include www.imagingpanda.com and Imaging Panda. The Imaging Panda website is an E-Commerce site. By using the Imaging Panda website, you consent to the data practices described in this statement. 

We take great care with your personal information that we gather when you access or use Imaging Panda and related websites, applications, and services owned and operated by Imaging Panda and that link to this Privacy Policy (collectively, the “Services”). This Privacy Policy is meant to help consumers that use our Services to explore diagnostic imaging centers or book appointments (“Consumers”) understand how we treat your personal information. By using or accessing the services in any manner, you acknowledge that you accept the practices and policies outlined in this privacy policy, and you hereby consent that we will collect, use, and share your information in the following ways. If you do not agree with this privacy policy, you may not use the services. If you use the services on behalf of someone else (such as your child) or an entity (such as your employer), you represent that you are authorized by such individual or entity to accept this privacy policy on such individual’s or entity’s behalf. A Consumer’s use of Imaging Panda’s Services is at all times subject to the Agreement (as the term “Agreement” is defined in our Terms and Conditions, which incorporates this Privacy Policy). You may print a copy of this Privacy Policy for your records. Thank you so much for choosing Imaging Panda.

HIPAA and PHI

Certain demographic, health and/or health-related information that Imaging Panda collects about Consumers as part of providing the Services to Imaging Facilities (“Client”) may be considered “protected health information” or “PHI” under the Health Insurance Portability and Accountability Act (“HIPAA”). Specifically, when Imaging Panda, acting as a “Business Associate” (as such term is defined in HIPAA) receives identifiable information about a Consumer from or on behalf of a Client, or Consumer’s doctor, other healthcare specialist, professional, provider, organization, medical diagnostics or imaging center, or agents or affiliates thereof (collectively, “Healthcare Facility”), this information is considered PHI. Personal data that a Consumer provides to Imaging Panda outside of the foregoing context is not PHI. For example, when you provide information directly to us, such as when using our interactive tools and services, searching for Healthcare Facilities or available appointments with Healthcare Facilities, and completing medical history forms (“Medical History Forms”); or when you voluntarily provide information in free-form text boxes through the Services or through responses to surveys and questionnaires, or post reviews; or when you send us an email or otherwise contact us, that information is not PHI.

HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. Imaging Panda may only use and disclose PHI in the ways permitted by a Consumer’s Healthcare Provider(s) or authorized by a Consumer.

Personal Data

The following subsections detail the categories of Personal Data that we collect. “Personal Data” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules or regulations. For each category of Personal Data, these subsections also set out the source of that Personal Data, our commercial or business purpose for collecting that Personal Data and the categories of third parties with whom we share that Personal Data. More information regarding those sources and categories are set forth below.

Collection of your Personal Information

In order to better provide you with products and services offered on our Site, Imaging Panda may collect personally identifiable information. More information regarding those categories of personally identifiable information are set forth below:

-Referring webpage/source through which you access the Services
-Non-identifiable request IDs
-Statistics associated with the interaction between device or browser and the Services

6) Geolocation Data

If you purchase Imaging Panda's products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.  

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. These may include: (a) registering for an account on our Site; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

Use of your Personal Information

Imaging Panda collects and uses your personal information to operate its website(s) and deliver the services you have requested. 

Imaging Panda may also use your personally identifiable information to inform you of other products or services available from Imaging Panda and its affiliates.

Sharing Information with Third Parties

Imaging Panda does not sell, rent or lease its customer lists to third parties. 

Imaging Panda may share data with trusted partners (including, but not limited to) to help Consumers schedule appointments through our Services, process payments, perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Imaging Panda, and they are required to maintain the confidentiality of your information. 

Imaging Panda may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Imaging Panda or the site; (b) protect and defend the rights or property of Imaging Panda; and/or (c) act under exigent circumstances to protect the personal safety of users of Imaging Panda, or the public.

Tracking User Behavior

Imaging Panda may keep track of the websites and pages our users visit within Imaging Panda, in order to determine what Imaging Panda services are the most popular. This data is used to deliver customized content and advertising within Imaging Panda to customers whose behavior indicates that they are interested in a particular subject area.

Automatically Collected Information

Information about your computer hardware and software may be automatically collected by Imaging Panda. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Imaging Panda website.

Use of Cookies

The Imaging Panda website may use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. 

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize Imaging Panda pages, or register with Imaging Panda site or services, a cookie helps Imaging Panda to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Imaging Panda website, the information you previously provided can be retrieved, so you can easily use the Imaging Panda features that you customized. 

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Imaging Panda services or websites you visit.

Security of your Personal Information

Imaging Panda secures your personal information from unauthorized access, use, or disclosure. We seek to protect your personal information from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of personal information and how we are processing that data. We endeavor to follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and in storage. For example, the Services use industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of Personal Data.

When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. 

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:
-Delete your personal information from our records; and
-Direct any service providers to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:
-Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
-Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
-Debug to identify and repair errors that impair existing intended functionality;
-Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
-Comply with the California Electronic Communications Privacy Act;
-Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
-Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
-Comply with an existing legal obligation; or
-Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Children’s Privacy

Imaging Panda does not knowingly collect personally identifiable information from children under the age of thirteen. If you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any Personal Data. By accessing, using and/or submitting information to or through the Services, you represent that you are not under the age of 13.

If you are between age thirteen (13) and the age of majority in your place of residence, you may use the Services only with the consent of or under the supervision of your parent or legal guardian. If you are a parent or legal guardian of a minor child, you may, in compliance with the Agreement, use the Services on behalf of such minor child. Any information that you provide us while using the Services on behalf of your minor child will be treated as Personal Data as otherwise provided herein.

If you use the Services on behalf of another person, regardless of age, you agree that Imaging Panda may contact you for any communication made in connection with providing the Services or any legally required communications. You further agree to forward or share any such communication with any person for whom you are using the Services on behalf.

E-mail & SMS Communications

From time to time, Imaging Panda may contact you via email or SMS for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. 

If you would like to stop receiving marketing or promotional communications via email or SMS from Imaging Panda, you may opt out of such communications by emailing help@imagingpanda.com

External Data Storage Sites

We may store your data on servers provided by third party hosting vendors with whom we have contracted.

Changes to this Statement

Imaging Panda reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy information on this page. Your continued use of the Site and/or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
